What the Ground Erases, What the Hekesh Demands, and What One Issur Blocks
One clean page for the talmid who needs to review the whole stretch.
Sevara of the Whole Sugya
The Torah works on distinct planes:
- physical attachment,
- formal designation,
- catalytic process (water vs fruit juice),
- sequential occupation of issur-slots.
Once the talmid sees the planes, every apparent contradiction (tahor yet asur; permitted yet must burn; kohen yes / Yisrael no; demai yes / tevel no) resolves into clean, consistent sevara.
Terms of Art the Talmid Must Own
- גבי קרקע / השקה (gabei karka / hashakah) — physical joining to ground or well.
- חומרא דקדושה / מעלה (chumra de-kedusha / ma’alah) — residual stringency of designation that survives joining.
- חמשת מיני דגן (chameshet minei dagan) — the five grains alone valid for matzah.
- מי פירות (mei peirot) — pure fruit juice (no water).
- חמץ נוקשה (chametz noksheh) — incomplete leavening that carries only a lav.
- דמאי (demai) — produce from an am ha-aretz; Rabbinically one must separate maaser.
- שיבולים (shebolim) — ears of grain before threshing.
- תרומה גדולה / תרומת מעשר (terumah gedolah / terumat maaser).
- אין איסור חל על איסור (ein issur chal al issur) — one prohibition does not take effect on an item already under another.
- טבל (tevel) — produce from which required separations were not made.
- 🧩 היקש (heqqesh) — the parallel that ties chametz to matzah.
1. Planted Terumah (35a)
Plant terumah → it becomes tahor (no longer metamei) yet remains asur.
Bavel tried hesach hadaas as a psul haguf.
Eretz Yisrael rejected that as darkness.
Sevara: physical joining dissolves only a chatzitzah (the separation that is tumah).
It has no power over a positive shem of kedusha.
Therefore the item is clean of transmission yet still forbidden for the kohen to eat.
That residual chumra de-kedusha is the entire explanation.
What the physical joining actually buys you: only the cancellation of outward transmission. The inward designation remains.
2. The Five Grains and the Hekesh (35b)
Only the five species can become true chimutz.
Rice and millet putrefy (sirchon); they never leaven.
🧩 Heqqesh: only that which can become real chametz can serve as matzah.
Direction is one-way.
3. Mei Peirot — the Graded Scale (Tosfos)
| Mixture | Chimutz level | Penalty | Ruling |
|---|---|---|---|
| Pure mei peirot (no water) | None at all | None | Completely permitted |
| Mei peirot + water | Chametz noksheh only | Lav only | Bake / burn at once |
| Barley first soaked in water → wine | Full chametz | Possible karet | Real chametz mixture |
Rabeinu Tam: pure fruit juice never starts the process. Water is the catalyst.
Egg-water: Rashi doubts; R”T permitted it after the fourth hour on Erev Pesach (matzah ashirah).
4. Kohen vs Yisrael with Terumah / Challah (Rashi)
You are yotzei only with something that, had it become chametz, would be forbidden solely because of chametz.
Any extra issur acher breaks the 🧩 heqqesh.
Kohen — no extra issur → yotzei.
Yisrael with terumah — extra issur → not yotzei.
5. Demai
Valid for matzah.
Every person can declare his property hefker and become an ani.
Aniyim may eat demai.
Therefore the grain is considered potentially fit for the eater.
6. Maaser Taken from Shebolim
If maaser is separated while the grain is still in the ears (before threshing), terumah gedolah never becomes obligatory.
From then on only terumat maaser is required.
The extra Torah language “maaser min ha-maaser” teaches exactly this special case.
(After threshing the grain is already subject to terumah gedolah; separating maaser then does not exempt it.)
7. Tevel and Ein Issur Chal al Issur
Tevel (even Rabbinic) is invalid for matzah.
The 🧩 heqqesh requires that the grain, had it leavened, would be forbidden only because of chametz.
In tevel an independent issur is already present.
By the principle ein issur chal al issur, the issur of chametz never takes effect at all.
Therefore the grain is not the pure counterpart the heqqesh demands.
(Classic parallel: nevelah that dies on Yom Kippur — the prior issur blocks the Yom-Kippur issur.)
Core Sevarot to Carry in Your Pocket
- Ground / well erases separation; it never erases a name.
- The heqqesh of chametz–matzah runs only one direction and demands purity of issur.
- Water is the indispensable catalyst for real chimutz; pure fruit juice stands outside the category.
- An extra issur already present occupies the slot; a second issur cannot land.
- Timing of separation (before or after the grain becomes subject to terumah gedolah) permanently changes the obligations that remain.
