Example
Gemarah Pesachim 18a–19a as taight by Rav Avigdor Miller ztl
User
"Explain the overall kashya is it to precisely delimit where the principle of kal vahomer runs out of steam or is there more?"
Output
🕯️ Pesachim 18a–19a – Complete Sugya-Map
(All engines, all governors, all open kashyot)
1️⃣ Sugya A – “Batlu be-Me‘eiha”
Kashya: If R. Yehuda lets liquids make food 3° (like R. Yosei/R. Shimon), why call swallowed mei ḥatat totally nullified?
Terutz Trio:
a) Rabbinic-only tumah → Sages didn’t extend decree.
b) Nullified only from severe tumah (man/vessels); still 3° to food.
c) Rav Ashi: Waters turned foul → cannot be or give tumah.
Table:
| Liquid inside cow | Severe tumah | Light tumah | Rav Ashi |
|---|---|---|---|
| Status | Batel | Tamei | Batel |
Sevara haiku:
Waters swallowed—changed;
identity lost, chain snapped;
food alone feels stain.
Flag: ⚘ kal va-ḥomer – if foul liquids exempt, a-fortiori obvious cases exempt.
Open kashya: Who sets the smell-threshold of “foul”?
2️⃣ Sugya B – “Yitma vs. Yetamme”
Kashya: Does yitma mean passive “becomes impure” or intensive “renders impure”?
Terutz: Two verses needed – one for liquids defiled by sheretz, one by vessel – to teach both do not transmit to similar items.
Flag: 🧩 heqqesh – comparing severity of sources.
Open kashya: When does Torah repeat instead of letting kal va-ḥomer run?
3️⃣ Sugya C – “R. Yosei ←→ R. Akiva”
Kashya: If R. Yosei reads yetamme, must he accept Akiva’s full 2°→3°→4° chain?
Terutz: He adopts the grammar (liquids → food) but vetoes the chain – practical halakhah ≠ midrashic template.
Flag: ⚖️ binyan av – selective adoption of teacher’s tool.
Open kashya: What internal fuse lets him stop the engine mid-gear?
4️⃣ Sugya D – Twin Kal va-ḥomer Engines
| Engine | Start | Target | Brake | Status |
|---|---|---|---|---|
| A | Liquids → food 3° | 4° teruma, 5° kodesh | R. Yosei’s silence | Rejected |
| B | Verse gives 3° teruma | 4° teruma, 5° kodesh | Dayyo bypass (verse already gives 3°) | Accepted |
Flag: ⚘ kal va-ḥomer (both engines), 🧲 davar ha-lamed (dayyo governor).
Open kashya: Once dayyo is off, why not 5°→6° ad infinitum?
5️⃣ Sugya E – Rav Ashi’s Inventory Raid
Kashya: Maybe Akiva does accept 5°?
Terutz: Rav Ashi/Rav Kahana exit, check stock Mishna: kli metzaref for kodesh only goes to 4° – no 5° on shelf.
Flag: 🧲 davar ha-lamed me-inyano – silence as ceiling.
Open kashya: If Akiva never listed 5°, who installed the governor – text, logic, or policy?
🎯 Meta-Kashya (the real question)
Where is the fuel-cutoff for kal va-ḥomer?
– Verse-derived base?
– Categorical wall (ḥol / teruma / kodesh)?
– Recorded silence?
The sugya maps all three – and leaves the wrench in your hand.
Tool
checklist to test any kal va-chomer (6 items)
1. **Identify the asserted predicate** — what exact reason/fact is being transferred? (heqqesh/davar ha-lamed)
2. **Domain match** — does that predicate actually apply in both major and minor cases (same species/context)?
3. **Textual anchor** — is there a pasuk/baraita that narrows or broadens the predicate’s scope?
4. **Legal status parity** — are the levels of prohibition (kareis vs lav, derabbanan) comparable so that the a fortiori scale makes sense?
5. **Hidden exceptions** — are there known exceptions (e.g., chayah vs behemah, public vs private, eating vs hana'ah) that block transfer?
6. **Practical-poskim check** — even if logical, do accepted halakhic authorities limit or reject the kal va-chomer for policy/practical reasons?
Use in order: if any item fails, the kal va-chomer is suspect and may be refuted.
